The President of the Personal Data Protection Office asked the Polish Football Association for consents to the processing of images of children

The President of the Personal Data Protection Office, Mirosław Wróblewski, asked the Polish Football Association to indicate on what legal basis the Polish Football Association makes the participation of children in a football tournament conditional on their parents and guardians consenting to the use of children's images.

Information that granting permission to use images of minors is a condition for participation in the "Tymbark Cup" tournament organized by the Polish Football Association appeared in the media space.

Therefore, the President of the Personal Data Protection Office, acting on the basis of Article 58(1)(a) and (e) of the GDPR, sent a letter to the Polish FA in which he asked for clarification: on what legal basis the data controller accepts the lack of consent by guardians as a factor excluding them from participation in the tournament; whether the consent to the processing of the child's image constitutes a voluntary, specific, informed and unambiguous declaration of intent; for what purposes related to the statutory activities of the Polish Football Association it is necessary to process images of children.

The President of the Personal Data Protection Office also asked the Association to send the content of the consents already granted.
